The regulatory environment for Irish community, residential, and mental health services has changed more in the last 18 months than in the previous decade. The Patient Safety Act 2023, commenced September 2024, made notification of 13 prescribed incidents mandatory across designated centers and approved centers via NIMS. S.I. No. 1 of 2025, effective 31 March 2025, reduced the Regulation 31 incident notification timeline for nursing homes from three working days to two — and introduced a new quarterly restrictive practices reporting requirement. The Chief Inspector of Social Services gained compliance notice powers from 14 February 2025.

For Mental Health Commission approved centers, the environment is now dual-notification: Quality and Safety Notifications via the CIS within existing timeframes, plus Patient Safety Act notifications via NIMS within seven days. HIQA's current programme of assessment is explicitly focused on safeguarding of adults. The Mental Health Bill 2024, currently progressing through the Oireachtas, will expand MHC powers to all community mental health residences, services, and all community Child and Adolescent Mental Health Services.
